Terms of Service

1. Acceptance of Terms

By accessing and using the PracticeSafe training platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

PracticeSafe provides online workplace safety training, induction programs, and certification services. Our service includes:

• Access to video-based training modules
• Interactive assessments and quizzes
• Certification upon successful completion
• Progress tracking and course resumption
• Certificate validation and verification services

3. User Accounts

To access our services, you must:

• Create an account with accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old or have parental/guardian consent
• Use your real name and contact information

You are responsible for all activities that occur under your account. Account sharing is strictly prohibited.

4. Payment and Pricing

Prices are displayed in Australian Dollars (AUD) on each module, course and business plan page, and are non-refundable except as required by Australian Consumer Law. There is no separate charge for a certificate. All prices include GST. Business subscriptions are billed monthly in advance and can be cancelled at any time from the billing portal; access continues to the end of the paid period.

Payment is processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method.

Prices may change with 30 days notice. Existing purchases are not affected by price changes.

5. Module Access and Validity Period

When you purchase a module:

• Access Period: You receive access to the module content for the certificate validity period shown on the module page (between 6 months and lifetime), counted from the date of purchase
• Free Retakes: You may retake tests unlimited times at no additional cost during the access period
• Access Expiration: When the access period ends, you may repurchase the module at its renewal price to regain access and earn a new certificate
• Certificate Validity: A certificate's validity period is set per module and printed on the certificate

Example: If a module's validity period is 12 months and you purchase it on 1 January 2026, you can access it and retake tests for free until 1 January 2027. If you pass on 15 January 2026, your certificate expires on 15 January 2027. To renew after that, you repurchase the module at its renewal price.

6. Certificates and Verification

Certificates issued by PracticeSafe:

• Are valid for the period set on the module (6 months to lifetime), printed on the certificate
• Require passing the assessment with the minimum passing score
• Include a unique validation code for verification
• May be verified by employers and authorities via our public verification system
• Must be renewed by retaking the course after expiry

You are responsible for ensuring your certificates remain valid for your employment or regulatory requirements.

7. Intellectual Property

All content on the Service, including training materials, videos, assessments, text, graphics, logos, and software, is the property of PracticeSafe or its content suppliers and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on our Service except as necessary for your personal, non-commercial use.

8. Prohibited Conduct

You agree not to:

• Share account credentials or allow others to use your account
• Record, copy, or distribute course content without permission
• Forge or manipulate certificates or validation codes
• Attempt to bypass payment or assessment systems
• Use automated systems to access the Service
• Interfere with the Service's operation or security
• Upload malicious code or attempt to hack the system
• Impersonate others or provide false information

Violation of these terms may result in immediate account termination and legal action.

9. Limitation of Liability

To the maximum extent permitted by law, PracticeSafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses.

Our liability for any claim arising from use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and obtain a refund for the unused portion, or to compensation for the reduced value of your services. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure is not a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

11. Disclaimer

While we strive to provide accurate and current information, PracticeSafe:

• Does not guarantee that training content meets all specific regulatory requirements in all jurisdictions
• Recommends verifying training requirements with your employer or relevant authority
• Provides educational content for general information purposes
• Does not replace hands-on training or workplace-specific safety procedures

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Previously issued certificates will remain valid for their original validity period.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Queensland.

15. Instructor (Author) Terms

These terms apply to accounts approved as instructors who publish modules or courses for sale on PracticeSafe.

• Licence: You keep ownership of your content and grant PracticeSafe a non-exclusive, worldwide licence to host, review, display, sell and deliver it to students, and to issue certificates for it, for as long as it is published here and for as long afterwards as existing students retain access.
• Review: Nothing you submit is sold until we have reviewed and approved it. We may request changes, set or adjust the sale price within the published range, or decline content. Approved content is published under your name.
• Updates: Changes to a live module are held as a draft and do not reach students until approved. We may archive content that becomes inaccurate or non-compliant; students who have purchased it keep access.
• Revenue share: For each completed card sale of your module, or of a course containing it, you earn the share percentage shown on the pricing page at the time of the sale, calculated on the sale amount excluding GST and after card processing fees (for a bundle, your module's slice of the bundle price in proportion to list prices). Voucher redemptions, free enrolments and test enrolments earn no share. Businesses may buy your module in volume as worker licences at the published percentage of your retail price; your share is calculated on the pack price when it is bought, whether or not every seat is used.
• Statements and payouts: A statement is generated on the first day of each month for the previous month and paid through Stripe to the payout account you connect, or by bank transfer where we agree. Refunds are deducted from the next statement; a negative balance carries forward. You are responsible for any tax on amounts paid to you and for providing an ABN or other details Stripe requires.
• Your warranties: You warrant that your content is your own or properly licensed, is accurate and current for Australian workplaces, does not claim to be nationally recognised or accredited training, and does not infringe any right of any person.
• Ending: Either of us may end this arrangement with 30 days' notice. Published content stays available to students who purchased it; you are paid any outstanding statements.

16. Business Subscription Terms

These terms apply to organisations that subscribe to run site inductions and training on PracticeSafe: sites with inductions, teams, training assignments and join links for contractors.

• Plans and limits: Each plan includes a number of sites and active workers (workers with an accepted invite to one of your sites) as shown on the pricing page. When a limit is reached, new sites or invites are paused until you upgrade; nothing already created stops working.
• Trial and billing: New subscriptions start with the free trial shown on the pricing page, without a card. Paid plans are billed monthly in advance through Stripe, GST included, and renew until cancelled. You can change or cancel your plan from the billing portal at any time; access continues to the end of the paid period. If a payment fails you have a short grace period to update your card before the console becomes read-only.
• Your content: Inductions you create are your responsibility. We do not review them. They must be accurate for your workplace, must not present themselves as nationally recognised training, and each carries our standard non-accredited disclaimer. You grant us a licence to host and deliver them to the workers you invite.
• Workers: Your workers are PracticeSafe users in their own right and never pay for your inductions. You see their completion of your sites' required modules, their certificates for those modules, and the status of your invites; their other training and purchases are private to them.
• Worker licences: seats of a catalogue module are bought at the published volume price, include GST, never expire while unused, are used when a worker you assigned first opens the module (and again on renewal unless you switch renewal off), and are refundable only while no seat has been used.
• Records: Completion records and certificates for your inductions remain available to you and to your workers after a subscription ends. You can export your completion data at any time.
• If a subscription lapses: you can still view and export records and edit your own content; new invites, joins, assignments, reminders and purchases pause until you choose a plan again. Workers keep access to what was already assigned.
• Refunds: subscription payments are not refunded for partial months; cancel from the billing portal and access runs to the end of the paid period. Your rights under the Australian Consumer Law are unaffected.
